1.3. We are an independent commercial entity. We are not an official governmental body and are not affiliated with any state-funded wine organisations.
1.4. The seller (or a natural person connected with the operator) is the owner of the international trademark registered with the World Intellectual Property Organization (WIPO) under registration number 1510292. The graphical representation of the brand, logos, texts, and all content of the Swiss Wine™ e-shop are protected by trademark and copyright laws. Any unauthorized use of these assets without the prior written consent of the owner is strictly prohibited.
2. Who These Terms Apply To
2.1. These Terms apply to orders placed through our website by customers located in India, subject to product availability, delivery availability, and legal shipping restrictions.
2.2. Certain products, especially alcoholic beverages, may not be available for shipment to all States or Union Territories.
2.3. By placing an order, you represent and warrant that the purchase, delivery, receipt, possession, and use of the ordered goods are lawful at your delivery location.
3. Age Restriction
3.1. You must have reached the minimum legal age required to purchase and receive alcoholic beverages at your delivery location.
3.2. You acknowledge that the legal age for the purchase, possession, and consumption of alcohol in India varies by State and Union Territory, and that alcohol sales or delivery may be restricted or prohibited in certain jurisdictions.
3.3. By placing an order containing alcoholic products, you represent and warrant that:
- you have reached the legal age applicable at your delivery location; and
- delivery of the ordered products to that location is lawful.
3.4. We may require age verification at checkout, before dispatch, and/or upon delivery.
3.5. If valid identification or age verification is not provided when requested, delivery may be refused and the goods may be returned to us.
4. Products
4.1. We take reasonable care to ensure that product descriptions, prices, images, and availability information are accurate.
4.2. Minor differences in packaging, labels, vintages, bottle presentation, or product appearance may occur.
4.3. All products are offered subject to availability.
5. Ordering and Contract Formation
5.1. When you place an order through our website, you are making an offer to purchase goods from us.
5.2. A legally binding contract is formed only when we send you an order confirmation email accepting your order.
5.3. We may refuse or cancel an order before dispatch, including where:
- the goods are unavailable;
- there is an obvious pricing or listing error;
- we reasonably suspect fraud, misuse, or unlawful activity;
- we cannot complete age verification or shipping compliance requirements; or
- delivery to the requested address is unavailable or not legally permitted.
5.4. If we cancel an order after payment has been taken, we will refund you in accordance with these Terms.
6. Prices, Taxes, Duties, and Compliance
6.1. All prices shown on the website are in Indian Rupees (INR) unless otherwise stated.
6.2. The final amount payable by you will be shown at checkout before you place your order.
6.3. The final amount shown at checkout may include:
- the price of the goods;
- shipping charges; and
- any taxes or charges that we expressly state are being collected by us at the time of sale.
6.4. Additional customs duties, import charges, local levies, state excise duties, clearance charges, or regulatory compliance costs may apply depending on the product, delivery location, and shipping model.
6.5. For imported food products, Indian law requires compliance with applicable packaging and labeling rules, and the Food Importer must not import food that is not packaged and labeled as required under the applicable regulations.
6.6. Where applicable, the customer may be required to act as importer, consignee, or recipient for customs or local compliance purposes and may be required to provide information, documentation, declarations, or cooperation needed for clearance.
6.7. We reserve the right not to accept or fulfill any order where customs, FSSAI, state excise, or other local compliance cannot be ensured.
7. Payment Methods
7.1. We may accept payment by one or more of the following methods:
- Bitcoin or Satoshis;
- Lightning Network;
- PayPal;
- credit or debit card; or
- any other payment method displayed at checkout.
7.2. Payment must be successfully authorized before dispatch.
8. Cryptocurrency Payments
8.1. If you choose to pay in Bitcoin or Satoshis, you acknowledge that cryptocurrency values are volatile.
8.2. For a standard discretionary return accepted under our return policy, any refund may be made in the same amount of Satoshis originally received by us, unless we agree otherwise or applicable law requires a different outcome.
8.3. Nothing in this clause limits any rights you may have under applicable law in relation to faulty, damaged, misdescribed, or non-delivered goods.
8.4. Where applicable law requires a refund by reference to the INR purchase price, we will comply with that law.
9. Shipping and Delivery
9.1. We ship to selected Indian States and Union Territories only.
9.2. Estimated delivery times are provided for information only and are not guaranteed.
9.3. We will deliver to the shipping address provided in your order confirmation.
9.4. Risk of loss or damage to goods passes to you when the goods are delivered to the delivery address, to the extent permitted by applicable law.
9.5. If delivery cannot be completed because age verification fails, the recipient refuses delivery without lawful reason, the address is incorrect or incomplete, or the recipient repeatedly fails to accept delivery, we may charge you for reasonable redelivery or return costs where permitted by law.
10. Title to Goods
10.1. Title to the goods passes to you only when:
- we have received payment in full; and
- the goods have been delivered to you.
11. Returns and Refunds
11.1. Except where required by law or expressly stated in these Terms, we do not offer a general unconditional right to return non-defective goods after delivery.
11.2. If you wish to request a return for non-defective goods, please contact us at swisswine@swisswine.in. Any acceptance of such return is at our discretion unless applicable law requires otherwise.
11.3. If we accept a discretionary return of non-defective goods:
- you must contact us within 7 days of delivery;
- goods must be returned in saleable condition, subject to applicable law;
- you are responsible for direct return shipping costs unless we agree otherwise.
11.4. We will provide return instructions if your return request is approved.
12. Damaged, Defective, or Incorrect Goods
12.1. If goods are damaged, defective, or not as described, please contact us as soon as reasonably possible at swisswine@swisswine.in.
12.2. Please include:
- your order number;
- a description of the issue; and
- photographs of the packaging and goods, where available.
12.3. Where required by applicable law, we will provide an appropriate remedy, which may include replacement, refund, or other remedy required by law.
13. Our Right to Cancel
13.1. We may cancel a contract and refund you if:
- the goods are unavailable;
- we are unable to ship for legal or operational reasons;
- we reasonably suspect fraud or misuse;
- age verification or local compliance requirements cannot be met; or
- there is an obvious pricing or listing error.
14. Promotions, Discounts, and Vouchers
14.1. Promotions, discount codes, and vouchers are subject to any additional terms stated with the relevant offer.
14.2. Unless expressly stated otherwise:
- promotions cannot be combined;
- vouchers have no cash value; and
- we may withdraw or amend promotions at any time before a contract is formed.
15. Intellectual Property
15.1. All website content, branding, text, images, graphics, logos, product descriptions, and other materials on this website are owned by us or our licensors and are protected by intellectual property laws.
15.2. You must not copy, reproduce, distribute, exploit, or commercially use any website content without our prior written consent.
16. Independent Status Statement
16.1. www.swisswine.in is an independent global e-commerce and distribution platform operated by Swiss Wine s.r.o.
16.2. We are not an official governmental entity and are not affiliated with any state-funded wine promotion organisations.
16.3. Our mission is the international sale, distribution, and commercial development of Swiss wine products for global markets.
17. Limitation of Liability
17.1. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or rights that cannot lawfully be waived under applicable law.
17.2. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for delay or failure caused by events outside our reasonable control.
18. Consumer Complaints
18.1. If you have a complaint, please contact us first at swisswine@swisswine.in.
18.2. Please include your name, order number, and a brief description of the issue.
18.3. In accordance with the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer to address consumer concerns.

20. Governing Law and Jurisdiction
20.1. These Terms are governed by the laws of India only to the extent mandatorily applicable to consumer-facing rights and obligations in relation to Indian customers, and otherwise by the laws of the Czech Republic.
20.2. Nothing in these Terms is intended to deprive consumers in India of rights that cannot lawfully be waived under applicable Indian law.
20.3. Subject to applicable consumer law, disputes shall be submitted to the competent courts or consumer fora having jurisdiction under applicable law.
21. Changes to These Terms
21.1. We may update these Terms from time to time.
21.2. The version published on the website at the time you place your order will apply to your contract.
